MINUTES
The Willington Zoning Board of Appeals held a public hearing at the Town Office Building, 40 Old Farms Road, Willington, CT at 7:30 p.m.

PUBLIC HEARING
Chr. Csiki continued the public hearing for application #2000-07 from May 24, 2000.
2000-07 - Application for a variance for an installation of cellular antennas on an
existing sign located at 327 Ruby Road. (Map 42 Lot 45 R80 Zone)
Owner/Applicant: Royce Properties, LLC/Springwich Cellular, LP
(Received 4/13/2000, Opened Public Hearing on 5/11/200 Continued
Public Hearing to 5/24/2000, 6/8/2000)
Chr. Csiki noted that N. Potvin was absent for the special meeting on 5/11/00 and has listened to the tape of the meeting and been brought up to date and R. Maloney was absent for the meeting on 5/24/00 and has also been brought up to date.
A letter dated 6/6/00 from K. Coppins, SNET Wireless, was read, stating that he would be unable to attend the meeting tonight.
Chr. Csiki asked if the documentation received was enough to make a decision.
Hearing no other comments, Chr. Csiki closed public hearing at 7:33 p.m.
Chr. Csiki opened public hearing for application #2000-08.
Members seated same as above.
2000-08 - Application for a front yard variance to enlarge second floor to include master bedroom, bedroom, and bathroom located at 72 Old Farms Road. (Map 17 Lot 3 R80 Zone). Owner/Applicant: Ken Fluet (Received 5/11/2000, Open Public Hearing by 7/13/2000)
A site walk was conducted on 5/24/00 at 6:00 p.m. Present: Chr. Csiki, D. Brown,
R. Manaskie, N. Potvin, S. Goodrich and Mr. and Mrs. Fluet. It was noted that a 9’ front yard variance would be required on Clint Eldredge Road.
Mr. Fluet was present and told the board that he would like to enlarge the second floor to
add a master bedroom, bedroom and a bathroom.
A conversation regarding front yard and side yard followed.
A letter was received from S. Trueb to ZBA dated 6/8/00 in favor of application
#2000-08.
Chr. Csiki asked if there were anyone present to speak in favor or in opposition of application #2000-08. There were none. No correspondence received in favor or in opposition of application #2000-08.
Chr. Csiki closed the public hearing at 7:41 p.m.
Chr. Csiki opened the public hearing for application #2000-09.
Members seated same as above.
2000-09 - Application for front yard variance for existing deck located at 137 River
Road. (Map 15 Lot 17 R80 Zone) Owner/Applicant: John and Flora
Bellman (Received 5/11/2000, Open Public Hearing by 7/13/2000)
Mr. Bellman was present to request a front yard variance for a deck that was already built.
Chr. Csiki stated that the variance is required because the house it too close to the road. A 28’ front line variance is required.
Chr. Csiki asked Mr. Bellman how did they get to the point that the deck was already built.
Mr. Bellman explained that they went to the Town Office to get a building permit. G. Jones, Assistant Zoning Agent informed the Bellman’s that they would need to get a variance and would need an A2 survey. The Bellman’s went home with the paperwork and got in touch with their son, who is in the building business. Their son told them he would pull the permits. The deck was then constructed without permits.
Chr. Csiki read a letter from G. Jones dated 4/6/00 regarding a notice of violation and also submitted into the record, a two page history of the construction of deck at 137 River Road dated 4/6/00.
Chr. Csiki informed both Mr. and Mrs. Bellman that this was a serious violation. Further, that even though their son was acting as their agent, they were responsible for what happened.
Oh behalf of the board, Chr. Csiki informed Mr. and Mrs. Bellman that the board had a responsibility to maintain the integrity of the regulations and process, the town officials charged with their implementation and enforcement and that of the Zoning Board of Appeals. Mr. Bellman concurred.
Mr. and Mrs. Bellman apologized for their son.
Chr. Csiki discussed 3 options; 1) grant variance, 2) problem was self created, deny variance and direct Zoning Enforcement Officer to start legal proceeding, and 3) grant variance and pay fine.
Mr. Bellman stated that the third option was agreeable.
Mr. Bellman has agreed to pay a fine of $250.00 contingent on the board granting the variance. Mr. and Mrs. Bellman feel that this is a fair agreement.
Chr. Csiki asked if there were anyone present to speak in favor or in opposition of application #2000-09. There were none. No correspondence received in favor or in opposition of application #2000-09.
Chr. Csiki closed the public hearing at 8:05 p.m.
REGULAR MEETING
Chr. Csiki called the regular meeting to order.
Members seated same as above.
MINUTES
May 11, 2000 – a motion to approve as read by R. Maloney, seconded by R. Manaskie. All in favor.
May 24, 2000 R. Claus was absent. R. Manaskie was seated for R. Claus.
CORRESPONDENCE
1. Summons from Superior Court re: 111 Daleville School Road
2. Budget detail – a new tape recorder is needed and good quality tapes.

4. S. Trueb letter re: 72 Old Farms Road Application
OLD BUSINESS
Application #2000-07 – A motion was made by R. Maloney seconded by R. Manaskie
to approve application 2000-07 based on the material submitted by K. Coppins, dated June 6, 2000 showing the cellular antennas located on the side of the sign structure.
Vote: Yes- R. Maloney, R. Manaskie, N. Potvin
No- D. Brown, C. Csiki
Motion failed to carry as 4 votes are required in the affirmative for the granting of a variance.
A motion was made by D. Brown to approve an alteration of the existing sign structure for the installation of cellular antennas located at 327 Ruby Road providing that the existing structures overall dimensions are not enlarged. Seconded by N. Potvin
Vote: Yes, R. Maloney, R. Manaskie, N. Potvin, D. Brown, C. Csiki
Motion passed
Application #2000-08 – A motion was made by R. Maloney to grant a 9’ front line variance on Clint Eldredge Road, seconded by R. Manaskie. All in favor, passed unanimously.
Application #2000-09 – A motion was made by R. Maloney to grant a 28’ front line variance with the stipulation that a $250.00 fine be payable to the Town of Willington, seconded by N. Potvin. All in favor, passed unanimously.
Preapplications for July will be received and public hearings will be held in August. Site walks will be scheduled for any preapplications received for the July meeting. Notification will be made by mail.

A motion was made by R. Maloney to adjourn, seconded by R. Manaskie. All in favor, adjourned 9:15 p.m.
